Court of Appeals Holds Grandparenting Time is Unconstitutional

In DeRose v. DeRose (2002) the Court held that grandparents have no constitutional right to petition a Michigan court for grandparenting time.

Previously, Michigan's grandparenting rights statute gave judges the authority to determine whether it was in the "best interest" of children to have time with their grandparents. In DeRose, the Court held that grandparenting time imposed by law infringes upon the fundamental rights of parents to raise their children as they see fit.

As a result of the Court's ruling, those who have court-granted grandparenting time schedules may find them unenforceable. Grandparents will have to rely on persuasion and communication skills in the absence of court enforcement power.
